Mammoth Bridges Development Company, L.L.C. (“MBD”) plans to take all commercially reasonable efforts to maintain up to date and effective online privacy standards and practices. We have linked every page of the Altis web site (the “Altis Site”) to this page for your convenience. If you choose to visit the Altis Site, your visit and any dispute over privacy is subject to this Privacy Policy and our Terms of Use, including but not limited to application of the law of the State of California.

Information We Collect

We at MBD are committed to respecting your online privacy and recognize your need for appropriate protection and management of any personally identifiable information you share with us. Personal information (“Personal Information”) means any information that may be used to identify an individual, including, but not limited to, a name, a home or other physical address, a phone number, an email address, and/or other contact information, whether at work or at home.

MBD has established this Privacy Policy as an explanation of the Personal Information we collect and how we use it. We also want you to understand the care with which we intend to treat your Personal Information. This Privacy Policy applies to the Altis Site and governs data collection and usage.

MBD may also collect non-personally identifiable information about you, such as your use of the Altis Site, communication preferences, travel habits, and responses to promotional offers and surveys.

The Altis Site may contain links to other websites. MBD encourages you to review the privacy statements of any websites you choose to link to from the Altis Site to understand how those websites collect, use and share your information. MBD is not responsible for the privacy statements or other content on websites outside of the Altis Site.

Use of Personal Information

In most cases, the information you provide is added to a local or global database. In the course of processing your Personal Information, it may be necessary to transfer your Personal Information to MBD’s affiliates and/or third party service providers located in the United States.

Affiliated or unaffiliated third parties may provide certain services on the Altis Site. Generally, MBD does not lend, sell, rent or lease the Personal Information of its customers to unaffiliated third parties, although personal Information may be stored in a third-party database held on MBD’s behalf. In such cases, said third-party service providers may have access to the Personal Information. MBD will take reasonable steps to ensure that these third-party service providers are obligated to protect Personal Information on MBD’s behalf.

Situations in which MBD may disclose your Personal Information to others include:
• when we have received your consent to do so;
• when companies or service providers who perform business activities on behalf of MBD require such information (e.g., credit processing and evaluation, customer support services, MBD products and services, market research administration or database management services);
• in the event MBD is merged into or acquired by another company;
• to comply with legal or regulatory requirements or obligations in accordance with applicable law or court order; and/or
• in case of emergency such as to safeguard the life, health, or property of an individual.

If information is shared as mentioned above, we seek to limit the scope of information that is furnished to the amount necessary for the performance of the specific function. Unless otherwise precluded by legal process, we require third parties to protect your Personal Information and abide by applicable privacy laws and regulations.

Accuracy of Personal Information

To ensure that your Personal Information is accurate and up to date, we encourage you to regularly review and update your information as appropriate (e.g., in the event your home or email address changes, or you wish to add an additional method for us to communicate with you). Where we collect Personal Information from you on the web, our goal is to provide a means of contacting MBD should you need to update or correct that Information. If for any reason those means are unavailable or inaccessible, you may send updates and corrections about your Personal Information to Carrie Hiltscher, chiltsher@Starwood.com and we will make reasonable efforts to incorporate the changes in your Personal Information that we hold as soon as practicable. Please note that in an effort to prevent the unauthorized disclosure of your Personal Information, you may be asked to provide proof of identity or other authentication materials.

If you wish to deactivate your profile or update your Personal Information, we will endeavor to do so in a timely manner. Occasionally, information that you request to be removed will be retained in certain files for a period of time in order to properly resolve disputes or to troubleshoot problems. In addition, some types of information may be stored indefinitely on back up systems or within log files due to technical constraints, or financial or legal requirements. Therefore, you should not always expect that all of your Personal Information will be completely removed from our databases in response to your request.

Choice

You may choose whether or not to provide Personal Information to MBD. If you choose not to provide the Personal Information we request, you can still visit most of the Altis Site, but you may be unable to access certain options, offers, and services that involve our interaction with you.

Security

Wherever your Personal Information may be held within MBD or on its behalf, we intend to take reasonable and appropriate steps to protect the Personal Information that you share with us from unauthorized access or disclosure. As effective as modern security practices are, you should be aware that no physical or electronic security system is impenetrable. We therefore cannot guarantee the security of our database(s) or any other database(s) that we manage, nor can we guarantee that the information you supply will not be intercepted while being transmitted over the Internet.

Protecting your privacy online is an evolving area and the Altis Site is constantly evolving to meet these demands. On-Line Technologies

MBD may use cookies, invisible pixels, and web beacons to obtain information about you while visiting our web sites. A cookie is a small text file that that is sent to your browser from a web server and stored on your computer’s hard drive. It assigns the computer with a unique identifier, which in turn, becomes your identification card whenever you return to the Altis Site.

Cookies are designed to save you time because they help us to provide you with a customized experience without you having to remind us of your preferences each time you return to our web pages. MBD cookies are not designed to damage your files, nor can they read information from other files on your computer hard drive.

If you would prefer not to have the benefits of cookies, your Internet browser can be adjusted to treat cookies in different ways. Depending upon the type of browser you are using, you may be able to configure your browser so that: (a) you are prompted to accept or reject cookies on an individual basis, or (b) you may be able to prevent your browser from accepting any cookies at all. You should refer to the supplier or manufacturer of your web browser for specific details about cookie security. However, you should also understand that rejecting cookies might affect your ability to perform certain transactions on the Altis Site and our ability to recognize your browser from one visit to the next.

MBD also uses invisible pixels, sometimes called web beacons, to count how many people visit certain web pages. Information collected from invisible pixels is used and reported in the aggregate and does not contain personally identifiable information. MBD may use this information to improve marketing programs and content.

Minors

MBD does not seek to obtain nor does it wish to receive Personal Information directly from minors; however, we cannot always determine the age of persons who access and use the Altis Site. If a minor (as defined by applicable law) provides us with his/her data without parental or guardian consent, we encourage the parent or guardian to contact us to have this information removed and to unsubscribe the minor from future MBD marketing communications.

Consent

BY ACCESSING, USING, VIEWING, TRANSMITTING, CACHING OR STORING THE ALTIS SITE OR ANY OF ITS SERVICES, FUNCTIONS OR CONTENTS, YOU SHALL BE DEEMED TO HAVE AGREED TO EACH AND ALL OF THE TERMS, CONDITIONS, AND NOTICES CONTAINED HEREIN. IF YOU DO NOT AGREE, PLEASE CEASE USE OF THE ALTIS SITE AND LEAVE THE ALTIS SITE IMMEDIATELY.

In certain circumstances, we will seek your express permission when we collect information that is regarded under certain data privacy regulations to be sensitive in nature (e.g., information revealing racial or ethnic origin, political opinions, or health conditions).

Changes to this Policy

We reserve the right to modify or amend this Privacy Policy at any time. If you do not agree to each of the practices in this Privacy Policy, please do not use the Altis Site. Each time you use the Altis Site, the current version of the Privacy Policy will govern your use.
